Terms of Service

1. Acceptance of Terms

By accessing or using BizBrew ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and "you" refers to both you individually and the organisation.

If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

BizBrew is a white-label multi-tenant SaaS platform designed for service businesses. The platform provides tools for scheduling, bookings, payments, client management, invoicing, memberships, analytics, and more. Each tenant operates within an isolated environment with its own domain, branding, and configuration, all powered by shared infrastructure.

We continuously improve and update the Service. We may add, modify, or discontinue features with reasonable notice. Core functionality covered by your subscription plan will not be materially reduced without prior notification.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must notify us immediately if you suspect any unauthorised access to your account. We are not liable for any loss arising from unauthorised use of your account where you have failed to safeguard your credentials.

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account and use the Service.

4. Subscription Plans & Billing

BizBrew offers a free tier with limited features and paid subscription plans (Starter, Growth, and Pro) with additional capabilities, modules, and higher usage limits. Detailed plan information is available on our pricing page.

All payments are processed securely through Stripe. Paid plans are billed on a monthly or annual basis, as selected at checkout. Subscription fees are charged in advance at the beginning of each billing cycle and are non-refundable except where required by applicable law.

You may upgrade, downgrade, or cancel your subscription at any time through your account settings. Downgrades and cancellations take effect at the end of the current billing period. If you downgrade, features not included in the lower plan may become inaccessible, but your data will be preserved.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service for any illegal, fraudulent, or harmful activity.
  • Attempt to gain unauthorised access to other tenants' data, accounts, or systems.
  • Transmit malware, viruses, or any other malicious code through the Service.
  • Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
  • Use automated means (bots, scrapers) to access the Service in a manner that exceeds reasonable usage or circumvents rate limits.
  • Resell, sublicense, or redistribute access to the Service without our written consent, except through the white-label tenant functionality as intended.
  • Upload or distribute content that infringes on intellectual property rights or violates applicable laws.

We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice depending on the severity of the violation.

6. Intellectual Property

The BizBrew platform, including its source code, design, features, documentation, trademarks, and logos, is owned by BizBrew and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during the term of your subscription.

You may not copy, modify, distribute, reverse-engineer, or create derivative works from the Service or its underlying technology, except as expressly permitted by these Terms or applicable law.

7. Data Ownership

You retain full ownership of all data you upload, create, or store on the BizBrew platform ("Your Data"), including client records, booking information, transaction history, and any content you create. BizBrew does not claim any ownership rights over Your Data.

You grant us a limited licence to process, store, and display Your Data solely for the purpose of providing and improving the Service. We will not sell, share, or use Your Data for advertising purposes.

You may export Your Data at any time using the built-in export functionality. Upon account termination, you will have 90 days to export Your Data before it is permanently deleted.

8. Service Availability

We target 99.9% uptime for the BizBrew platform and make commercially reasonable efforts to maintain availability. However, we do not guarantee uninterrupted access to the Service.

Planned maintenance windows will be communicated at least 48 hours in advance and scheduled during off-peak hours whenever possible. Unplanned downtime due to infrastructure issues, security incidents, or force majeure events is not a breach of these Terms.

9. Limitation of Liability

To the maximum extent permitted by applicable law, BizBrew and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims related to the Service shall not exceed the amount you paid to BizBrew in the 12 months preceding the event giving rise to the claim.

10. Termination

You may terminate your account at any time through your account settings or by contacting us. Upon termination, your access to the Service will cease at the end of your current billing period.

We may suspend or terminate your account immediately if you breach these Terms, engage in prohibited activity, or fail to pay subscription fees. We may also terminate your account with 30 days' notice for any other reason.

Upon termination, provisions that by their nature should survive (including Data Ownership, Limitation of Liability, and Governing Law) will continue in effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BizBrew is incorporated, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall first be addressed through good-faith negotiation. If a dispute cannot be resolved within 30 days, either party may seek resolution through binding arbitration or the competent courts of the governing jurisdiction.
